Faraci Lange's Buffalo attorneys, Frank J. Frascogna and Jennifer L. Fay, successfully negotiated a settlement with a home health agency in a medical malpractice case regarding the negligent care of a ten month-year-old girl by the agency's licensed practical nurse.
The child was born prematurely at 24 weeks and 4 days. She was hospitalized for eight months and discharged receiving nursing care through the home health agency. She was left in the care of an LPN during one evening in April of 2014. The LPN covering the overnight did not have the training necessary to provide proper ventilator support or care and treatment for the child and failed to notify her parents of changes in her condition. She died the following day from untreated bacterial endocarditis with infected vegetation, which was unrelated to the LPN's negligent care.
A settlement was negotiated with the home health agency for its LPN's negligent actions. Faraci Lange is proceeding with a separate wrongful death claim against the client's pediatric cardiologist for the wrongful death claim relating to the untreated bacterial endocarditis vegetation.
